I. General Terms and Conditions

§ 1 Basic Provisions

  1. The following terms and conditions apply to contracts concluded between you and us as the provider (Mehmet Can Celik) via the website www.haushaltswelt.shop. Unless otherwise agreed, the inclusion of your own terms, if used, is hereby opposed.

  2. A consumer, in the sense of the following provisions, is any natural person who concludes a legal transaction for purposes that are predominantly outside their commercial or independent professional activity. An entrepreneur is any natural or legal person, or a legally capable partnership, who acts in the exercise of their independent professional or commercial activity when concluding a legal transaction.

§ 2 Conclusion of the Contract

  1. The subject of the contract is the sale of goods.

  2. By listing the respective product on our website, we make you a binding offer to conclude a contract via the online shopping cart system, under the conditions stated in the product description.

  3. The contract is concluded via the online shopping cart system as follows:

    • The goods intended for purchase are placed in the "shopping cart."

    • By clicking the relevant button in the navigation bar, you can open the "shopping cart" and make changes at any time.

    • After clicking "checkout" or "continue to order" (or similar wording) and entering personal data, as well as payment and shipping conditions, the order summary will be displayed.

    • If you use an instant payment system (e.g., PayPal (Express/Plus/Checkout), Amazon Pay, Sofort), you will either be directed to the order overview page in our online shop or redirected to the payment provider's website.

    • After selecting and entering your details at the payment system, the order summary will be shown either on the payment provider's website or upon returning to our online shop.

    • Before submitting the order, you can review, change (also via the "back" function of the browser), or cancel the order.

    • By submitting the order via the corresponding button ("order with payment obligation," "buy now," "pay now," or similar wording), you legally accept the offer, thus concluding the contract.

  4. The processing of the order and the transmission of all necessary information related to the conclusion of the contract will be done by email, partially automated. You must ensure that the email address provided to us is correct and that emails are not blocked by spam filters.

§ 4 Right of Retention, Retention of Title

  1. You may only exercise a right of retention in relation to claims arising from the same contractual relationship.

  2. The goods remain our property until the full purchase price has been paid.

§ 5 Warranty

  1. Statutory warranty rights apply.

  2. As a consumer, you are asked to immediately inspect the goods upon delivery for completeness, obvious defects, and transport damages and inform us and the carrier of any complaints as soon as possible. Failure to do so does not affect your statutory warranty rights.

  3. If a characteristic of the goods deviates from the objective requirements, the deviation shall only be considered agreed upon if you were informed of it prior to placing the order, and the deviation was explicitly and separately agreed upon between the parties.

§ 6 Applicable Law

  1. German law applies. This choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country of the consumer's habitual residence (principle of favorability).

  2. The provisions of the UN Sales Convention explicitly do not apply.

3. Language of the Contract, Storage of the Contract Text

3.1. The language of the contract is German.
3.2. The full contract text is not stored by us. Before submitting the order via the online shopping cart system, the contract data can be printed or saved electronically using the browser's print function. After the order is received by us, the order data, legally required information for distance contracts, and the General Terms and Conditions will be sent to you by email.

6. Prices and Payment Terms

6.1. The prices listed in the respective offers, as well as shipping costs, represent total prices. They include all price components, including applicable taxes.
6.2. There are no shipping costs.
6.3. For deliveries to countries outside the European Union, additional costs such as customs duties, taxes, or money transfer fees (e.g., bank transfer or exchange rate fees) may apply, which are to be borne by you.
6.4. The costs of money transfer (e.g., bank transfer or exchange rate fees) must be borne by you if the delivery occurs within an EU member state, but the payment is made outside the European Union.
6.5. Available payment methods are listed under a clearly marked button on our website or in the respective offer.
6.6. Unless otherwise indicated, payment claims from the concluded contract are due immediately.

7. Delivery Conditions

7.2. As a consumer, it is legally regulated that the risk of accidental loss or deterioration of the sold goods passes to you upon delivery, regardless of whether the delivery is insured or uninsured. This does not apply if you independently instructed a carrier not named by the entrepreneur or another person to carry out the shipment.

The warranty rights are based on the "Warranty" provision in our General Terms and Conditions (Part I).
